Terms and conditions

Definition

Agreement means the quotation, acceptance and the following terms and conditions.

Work or works means behaviour consultation, training, handouts, written report, behaviour program, training program created by Nutty Mutts. It may also describe other services such as administrative, training meetings and other tasks which are necessary in the creation of the program.

Nutty Mutts means Nutty Mutts Dog Walking, Dog Training and Dog Grooming it can also extend to Gemma Mason and confirmed associates. 

The Client means the individual who requested the work.

Amendments means any alteration to the work.

 

Dog walking

The Client is solely responsible for any and all harm or damage caused by their dog while it is under the care of Nutty Mutts, or is using any other services provided by Nutty Mutts and agrees to indemnify Nutty Mutts in full against any liability arising from such harm or damage to third parties.

The Client agrees that, in admitting their dog, Nutty Mutts has relied on the Client’s representation that their dog is in good health and has not harmed or shown aggression or threatening behaviour toward any person or any other dog.

All dogs will be subject to an initial assessment by Nutty Mutts staff prior to using Nutty Mutt’s services. Nutty Mutts reserves the right to refuse admission to any dog deemed in their absolute discretion to be, or have the potential to be, dangerous or disruptive.

The Client agrees to notify Nutty Mutts immediately of any unwelcome, aggressive, procreative, or dangerous behaviour of their dog that has potential to cause harm to any other dog or individual.

Nutty Mutts offer services where dogs co-mingle in groups and the Client accepts that during the course of normal dog play their dog may sustain injuries. All dog play is carefully monitored to avoid injury, but scratches, punctures, torn ligaments, or other injuries may occur despite the best supervision.

Nutty Mutts will only let dogs off the lead at the discretion of Nutty Mutts staff and accept no liability in the event the dog becomes lost.

The client gives permission and by submitting the Nutty Mutts contract form, gives written consent to allow Nutty Mutts to walk their dog off the lead. The client understand that Nutty Mutts will not be be held responsible or liable in the event of any incident, injury or loss.

The Client is responsible for the full cost of treatment of any injuries or illness that their dog receives while under the care of Nutty Mutts, together with any associated costs e.g. call-out charges. The Client authorises the staff of Nutty Mutts to seek such veterinary advice and/or treatment as they deem necessary; where possible this will be carried out by the Client’s usual/preferred Vet, but this cannot be guaranteed (e.g. in an emergency) and the Client accepts that the staff of Nutty Mutts may at their discretion use any registered Vet. The Client agrees to pay all such costs immediately upon pick-up of their dog, or by agreement with the proprietor.

Nutty Mutts reserves the right to refuse admission if the Client fails to provide adequate proof of vaccinations, or the vaccinations are found to be expired or otherwise incomplete.

Bitches may not attend Nutty Mutts while in season or pregnant. Nutty Mutts reserves the right to refuse admission if these criteria are not met.

The Client accepts that even though their dog is vaccinated against Kennel Cough there is a chance that their dog can still contract Kennel Cough. The Client agrees that they will not hold Nutty Mutts responsible if their dog contracts Kennel Cough while attending.

The Client agrees to take any necessary measures or precautions to ensure that their dog is continuously free of contagious, infectious, or otherwise communicable diseases. The Client further agrees to notify Nutty Mutts immediately of any infectious and/or contagious disease or conditions their dog has been exposed to or is affected by. Such diseases and conditions include, but are not limited to: Distemper, Hepatitis, Kennel Cough, worms, Lyme disease, Fleas, Pregnancy, Infectious Skin Diseases and Intestinal Parasites. Nutty Mutts reserves the right to refuse admission until satisfied that the condition is resolved.

The Client consents to their dog being photographed, videotaped, and/or used in any media or advertising by Nutty Mutts without prior approval. All such media remain the property of Nutty Mutts.

The Client agrees that Nutty Mutts is not responsible for any lost, stolen, or damaged leads, collars, tags, clothing or any other item left with their dog.

The Client agrees to ensure their dog has not eaten in the hour before pick up by Nutty Mutts to ensure sufficient time to digest food before any exercise or play. Failure to do so may result in the potentially life-threatening condition Bloat (Gastric Torsion).

The Client agrees to provide keys/arrange access to the dog for the agreed appointment; failure to do so will result in a cancellation for that day’s service and will be paid in full by the client.

The Client agrees that by giving a key to their property to allow access to the dog, they will indemnify Nutty Mutts in full against any liability arising from loss or damage to the property or its contents, in present and future circumstances.

All dogs being walked will undergo a trial period to ensure that they are adequately trained and socialised. Walking times cannot be guaranteed.

Nutty Mutts reserves the right to cancel the contract at any time & with immediate effect if the dog does not respond well to the walker and/or other dogs.

The information and any treatment suggested consists of Nutty Mutt’s personal views and are based on the information given to Nutty Mutts by the client or person responsible for the animal(s) and or Nutty Mutt’s own conclusions resulting from personally gained evidence of the animal and the related behavioural problem, which must be put in writing within 24 hours of the walk to nuttymutts@outlook.com.

Nutty Mutts reserve the right to amend these terms and conditions at any time.

Nutty Mutts will apply personal judgment and reduce the time of a walk if necessary because of extreme weather conditions (ie, heat, thunder storms) for the safety of both the dogs and the walker. Nutty Mutts will make reasonable efforts to accomodate preferred walk times, however due to the variable nature of scheduling and operational demands, specific time slots cannot be guaranteed. 

If dogs require a quick towelling off after walks towels must be provided and left by the front door.

 

Cancellation Policy 

At Nutty Mutts, we understand that life can be unpredictable, and sometimes you may need to cancel or reschedule your dog’s session. However, as a small business, last-minute cancellations and no-shows significantly impact our schedule and ability to provide our services to other clients. To ensure that we can continue to offer the highest quality services, we have implemented the following cancellation policy.

Cancellation Notice Requirement

We kindly ask that you provide at least 48 hours' notice if you need to cancel or reschedule your dog walking, grooming or training session. This allows us to offer the slot to another client who may be waiting for an appointment.

Late Cancellations (Less Than 48 Hours' Notice). Cancellations made within 48 hours of the scheduled session will not be eligible for a refund and charged the full session fee. This policy is necessary to compensate for the time reserved for your session that cannot be reallocated on short notice.

No-Show Policy. If you do not show up for your scheduled session without any prior notice, the full session fee will be charged, and no refund will be issued.

Rescheduling Policy. If you need to reschedule your session, please do so with at least 48 hours' notice. Rescheduling within 48 hours of the appointment may result in the session fee being forfeited, as per the cancellation policy.

Packages. For clients who have purchased packages of 2+ sessions in advance, please note that a session will be deducted from your package if a late cancellation or no-show occurs, in accordance with the policies outlined above.

How to Cancel or Reschedule. To cancel or reschedule your session, please contact me directly via your usual means of communication.

Policy Acknowledgment. By booking an appointment with Nutty Mutts, you acknowledge that you have read, understood, and agree to abide by this cancellation policy.

Update due to XL Bully Ban:

1.The dog is registered with the index of exempted dog (IED) and a copy of the life certificate is obtained and provided in the event of a claim.

2. A copy of the public liability insurance certificate for the dog is obtained and provided in the event of a claim.

3. The dog handler ratio is 1:1 with their handler at all times 

4. The dog is Neutered – in line with Government terms

5. The dog is Micro Chipped

6. The dog is kept on a lead and muzzled at all times – in public

7. If walked on a 1:1 basis in a privately rented secure field, Nutty Mutts may remove the lead and muzzle on the following basis:

The field must be private property with no public access passing through

The field must be securely fenced so the dog cannot escape

The dog is kept on a lead and muzzled until the gate is shut when entering the field

The dog is put back on a lead and muzzled before opening the gate to leave the field

If the household has more than 1 dog, they can come to the field together as long as they have a minimum of 1 handler. All dogs leads and muzzles can be removed once in the field including the XL Bully.  

Dog Grooming

You are required to pay a £15 deposit to secure your appointment when booking. This can be carried over to future bookings should you wish. The deposit secures against any missed or cancelled appointments and will not be refunded unless you give over 48 hours’ notice of cancellation of your booking.

Any pets not collected at the agreed collection time will incur an additional charge of £5 per 30 minutes they are in holding after the collection time agreed.

Please ensure that your pet has been given the opportunity to be relieved before dropping off at the grooming salon. This will ensure that they get the maximum enjoyment out of their groom.

Please do not feed your pet within 30 minutes prior to their appointment.

All customers are responsible for keeping their pet up to date with their vaccinations.

We recommend puppies wait 2 weeks after their 2nd vaccination before booking a puppy groom.

You must inform the groomer of any medical conditions and may be asked for a letter from your vet stating your pet is healthy to be groomed before the groom is carried out.

Whilst every care is taken of the pets being groomed, any pet left within the grooming salon is left entirely at the owner’s risk.

We will not groom any dog that has been microchipped within the last 24 hours.

The grooming team have the right to refuse to groom any pet without reason.

The grooming team have the right to refuse any customer without reason.

The grooming team have the right to cancel a groom if it would affect the pet’s welfare to continue or there is a risk of injury to the grooming team.

Nutty Mutts will not be held responsible for any loss of personal items during the appointment.

Matted dogs

We will endeavour to groom your pet to your requirements, however if your pet’s coat is excessively matted, the matted coat will be clipped (shaved) out. Depending on the severity of the matted coat, which will be discussed during your pet’s consultation, there may be an additional charge in addition to the grooming price, with targeted de-matting (such as under the legs and behind the ears) at £5 or general de-matting over the body at £10 for up to a maximum of 15 minutes. After this 15 minute point, we will recommend a clip off for the dog’s welfare as per our Clipping Policy, therefore it may not be possible to achieve the style you desire. As groomers, our primary concern is to relieve any distress or discomfort your pet may be experiencing as a result of their severely or excessively matted coat. Should your pet come in heavily matted, due to the time it takes and special care needed to remove this, which will be explained by your groomer on view of your dog, carries a £10 additional charge to the grooming price. You will be made aware of any additional costs during your consultation.

Two Colleague Groom

There can be a number of reasons why it may be necessary for your dog to require two groomers to carry out a groom. If the behaviour of the dog warrants two groomers to carry out the groom, this will be charged per 30 minutes of time taken at £10. If it is to ensure the welfare of the dog (e.g. an older dog) and the groom requires two groomers, as with the above, this will be charged per 30 minutes of time taken at £10.

Extra Care

Pets which are pregnant or in season will not be accepted for a groom.

If your pet is found to have fleas, we will charge a fee of £15 in addition to the cost of the groom, where your pet will be bathed in a flea shampoo and the salon disinfected.

If your pet is found to have a tick, we will charge a fee of £5 to remove in addition to the cost of the groom. However we advise if your pet has a tick to see your vet, as they are known carriers of disease and may require further treatment.

Any pets that are deemed at the discretion of the grooming team to be in need of immediate veterinary attention will receive this and you agree that you will be liable for any resulting additional costs.

Any dogs that are aggressive towards a member of the grooming team or another pet may need to be muzzled. It is the owner’s responsibility to inform the groomer if they do not wish their pet to be muzzled. Refusal may result in the groom not taking place.

We strongly advise you insure your pet. Whilst we take every reasonable precaution to prevent it, we will not accept any responsibility for any loss, injury, death or illness suffered by your pet whilst in our care, except to the extent that we are unable to limit or extend our liability.

If your pet appears unwell at the time of the appointment, they will not be accepted for grooming due to the risk of cross infection to other pets.

Any complaints with regards to the Grooming salon must be put in writing within 24 hours of the groom to nuttymutts@outlook.com.

Nutty Mutts reserve the right to amend these terms and conditions at any time.

 

Boarding

Please read carefully and ensure you agree to our terms and conditions. By going ahead with your booking, the guardian of the animal is deemed to have accepted these terms and conditions. If you are unsure about anything or have any questions regarding any of our terms and conditions, please do not hesitate to contact us.

Booking: All new customers are required to complete our online booking form at the time of reservation. Booking confirmation will only be provided upon successful submission of the form. Please note that your reservation is not considered confirmed until you receive a confirmation from us and have submitted the required booking fee, which also serves as a deposit.

Vaccinations: All dogs must have an up-to-date vaccination certificate upon arrival at the boarding facility. This includes vaccinations against:

Canine distemper

Canine hepatitis

Leptospirosis

Canine parvovirus

Kennel Cough

Flea and worming treatment must have been carried out at least 28 days prior to your boarding date. Vaccinations must be completed at least four weeks (28 days) before the boarding start date, or as per the manufacturer's instructions. Proof of vaccinations (including dates) must be provided and kept on file during the dog's stay. Guardians must leave a copy of this evidence with the boarding facility when they drop off their dog.

Kennel Cough: The Kennel Cough vaccine does not give 100% protection against Kennel Cough, and the owner takes full responsibility for this. Nutty Mutts will not be liable if the dog catches kennel cough whilst in our care.

Liability: At Nutty Mutts, we strive to provide the best care for your pet. We advise that all pets are covered by adequate pet insurance, as all dog boarding and day care services are provided at the owner's risk. Nutty Mutts shall not be liable for any loss, injury, or death to the dog, except where such loss, injury, or death is directly caused by the gross negligence or willful misconduct of Nutty Mutts. Nutty Mutts is not responsible for any stress-related issues or illnesses that may arise during your pet's stay. Nutty Mutts is not responsible for any lost, stolen, or damaged personal belongings brought to the premises with the dog. Nutty Mutts is not responsible for any damage caused by the dog to the premises or the property of other guests. In case of emergencies, if we are unable to contact the owner or the designated emergency contact, we may act as your pet's guardian. This may include seeking veterinary care as deemed necessary to ensure their well-being. The owner is responsible for all associated veterinary costs. The owner acknowledges and consents to Nutty Mutts obtaining their pet's medical history if necessary.

Payment: Full payment is required 14 days before your pet's arrival. A payment reminder will be sent, and payment can be made via cash or bank transfer. A 25% non-refundable booking fee, which also acts as a deposit, is required to secure all bookings. While we will try to accommodate date changes after the deposit is paid, we cannot guarantee availability. If a booking is canceled more than 14 days before the start date, we may, at our discretion, issue a credit for a future booking within the next 12 months. No refunds will be given for shortened stays or early returns. You will be charged for the full duration of the original booking. Bookings canceled within 14 days of the start date are non-refundable. If full payment is not received 14 days before arrival, we cannot guarantee to hold the booking dates and may cancel the reservation at our discretion. We reserve the right to adjust our daily rates proportionally without notice to reflect unforeseen cost increases.

Opening Hours: No arrival or departures are allowed outside our opening time unless by prior arrangement.

Dog Behavior: To ensure the safety of all animals and our staff, first-time boarding guests may be required to meet with us prior to their stay. We may also require a trial stay. We reserve the right to decline any dog for boarding without explanation. We also reserve the right to cancel a booking if a dog exhibits challenging, aggressive, or destructive behavior during their stay, such as excessive barking, biting, aggression towards other dogs or humans, or destructive behavior. Dogs that are excessively fearful, anxious, or reactive may not be suitable for boarding. Dogs that fall within the scope of the Dangerous Dogs Act 1991 or are suspected of doing so will not be accepted for boarding. Owners are responsible for ensuring their dog is properly socialized and suitable for a boarding environment. Owners are responsible for any damage caused by their dog to the premises or the property of other guests.

Medication: Any medication requiring administration outside of our standard hours (7:30 AM - 5:30 PM) must be discussed and agreed upon in advance. An additional charge may apply for these services. Owners may provide written instructions regarding their dog's care, such as feeding schedules, exercise routines, and preferred playtime activities. Nutty Mutts will make every effort to follow these instructions, but cannot guarantee compliance in all circumstances.

Collection: If an animal is not collected within 14 days of the scheduled departure date and we have not received any communication from the owner or their designated agent, we reserve the right to re-home or place the dog into a shelter at our discretion.

Data Protection: We do not share any of your personal data. We use the information you provide solely for the purposes of your pet's booking and our services to you.

Owner Responsibilities: Owners are responsible for providing accurate and complete information about their dog, including medical history, vaccination records, and any behavioral concerns. Owners must provide accurate and up-to-date contact information, including emergency contacts. Owners are responsible for providing any necessary items for their dog during their stay, such as food, bedding, toys, and any prescribed medications.

If any provision of these Terms & Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.   

Nutty Mutts reserves the right to amend these Terms & Conditions at any time. Any changes will be posted on our website and will be effective immediately upon posting.

These Terms & Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written

Dog training and behaviour

Definition

The Client means the individual who requested the work.

Amendments means any alteration to the work.

Guarantee

Nutty Mutts shall create the agreed work for the use of the client. The client may use the work or works only in its original form and only for its original use for the animal named and described within the work.

Behaviour work cannot be guaranteed with any animal.

Nutty Mutts shall create behaviour and training programme to the specifications of the problems assessed at the first training session and will make amendments to the training and behaviour programme accordingly.

The training and behaviour programme is specific to the dog(s) that the programme has been designed for and should not be used in part or whole with any third party.

The client shall agree not to sell, destroy, deface, alter or part with work created by Nutty Mutts or permit it to be given or done so by any third party.

 

General

Work created by Nutty Mutts is charged to the client at the agreed amount.

The full charge of the service is payable at the first main consultation/training session.

Deadlines set in the agreement will not affect Nutty Mutt’s right to be paid.

If work is cancelled the client shall reimburse Nutty Mutts for any and all losses arising. In the event that work is cancelled, ownership of the work remains the property of Nutty Mutts and the Client is not authorised to use any part of the work.

Ownership of the work shall not pass to the client until all charges have been paid in full.

All work created by Nutty Mutts for the client is to be used for the sole purpose for which it was created. The client does not have the right to resell work created by Nutty Mutts or repurpose it without written consent from Nutty Mutts.

Nutty Mutts is entitled to assign any or all of its rights and obligations included in this agreement to third parties.

Nutty Mutts reserves the right to refuse to provide service or create work at its own discretion.

Nutty Mutts cannot always guarantee to start work immediately.

If no timescale has been agreed for a service Nutty Mutts will not be responsible for any losses to the client if deadline is not met.

Once the work meets the terms of the quotation with its specifications any modifications to the work will be considered an amendment to the contract and charged accordingly.

Amendments to programmes and training/classes may incur an additional charge beyond that of the original invoice.

All amendments must be agreed by both Nutty Mutts and the client.

Amendments may exceed original deadlines agreed by Nutty Mutts and the client.

Behaviour and training programmes are completed within the agreed timescale– this is confirmed at time of booking.

Payment

The client shall pay Nutty Mutts the full price of the service at the first consultation/training session.

Nutty Mutts expects payment in full by electronic bank transfer or cash.

All quotes and tenders are valid for a period of thirty days.

Interest will be charged per day on all payments received outside of payment terms at the rate of eight per cent above the Bank of England Base Rate.

Whilst outstanding payment is due Nutty Mutts reserves the right to withhold the designs services or goods.

Any payment returned by the bank or card company will incur £10 admin charge as well as any charges made by the bank

In case collection proves necessary, the client agrees to pay all fees (including all legal fees and court costs) incurred by that process. If for any reason whatsoever Nutty Mutts are unable to provide an agreed product or service in accordance with these terms and conditions our liability shall be limited in its entirety to a proportional refund of any fees paid by you for the service or product.

All administrative fees to third parties and the time taken to organise will be charged to the client irrespective of any quoted amount set out in the quotation with its specifications.

 

Sale Of Goods

By placing an order you agree to these Terms and Conditions which form the only agreement between us. Nutty Mutts reserves the right to make changes to the items shown on this website and to remove styles and goods.

We have made every effort to ensure that the colours and images used on this website give a good representation of the products themselves, but we cannot guarantee this due to monitor resolution/brightness.

 

Delivery

We will normally deliver goods within 5-10 working days subject to the goods being in stock. If there is going to be a delay for any reason we will advise you. We will not be liable for any consequential loss caused by failure of the carrier to deliver.

The price of the goods will be the price ruling at the date of order. All prices quoted include post, stamp, packing and VAT.

 

Cancellation And Termination

Nutty Mutts may, by written or verbal notice, terminate any agreement at its discretion:

If the client fails to pay which has become overdue.

If the client breaches any of the terms of the agreement.

If Nutty Mutts discovers that the client’s use of work produced is unethical misleading or morally corrupt.

If the client’s use is in anyway harmful to Nutty Mutts or its reputation.

The client may cancel the agreement at anytime but may be invoiced up to the full amount quoted based on the degree to which the work has been completed and on the extent to which time has been allocated to the project that cannot be effectively used to generate revenue that would be otherwise lost.

A service will be deemed as cancelled if there is more than 30 days from the first training or consultation.

No refunds will be issued.

 

Nutty Mutt’s LIABILITY

Nutty Mutts shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit.

Nutty Mutts will not be held responsible under any circumstances whatsoever to the Client for a lack of time, effort and circumstances from the work.

In no event will Nutty Mutts be liable to the client or any third party for damages or losses.

Nutty Mutts will not be liable for any loss, injury or liability to the client.

Handlers and/or owners remain responsible for their dogs at all times and are advised to ensure they have adequate pet or household insurance cover for liability in the unlikely event of damage or injury caused by their dog to property or to a third party.

 

COMMUNICATION

Nutty Mutt’s preferred method of communication is by messenger, message or email.

However, documents can be sent by traditional post, if no email address is available, this will incur a postal fee to send through reports to the client at the current postal rate and packaging.

Nutty Mutts shall not be held responsible for spelling mistakes or typing errors to any documents. Signatures are not required to start a contract; verbal communication, email or other exchanges are legally binding.

 

Complaints procedure

The information and any treatment suggested consists of Nutty Mutt’s personal views and are based on the information given to Nutty Mutts by the client or person responsible for the animal(s) and or Nutty Mutt’s own conclusions resulting from personally gained evidence of the animal and the related behavioural problem, which must be raised in writing within 24 hours of the initial consultation to nuttymutts@outlook.com.

Nutty Mutts reserve the right to amend these terms and conditions at any time.

Treatment plans, for the most part, will not be successful overnight. This requires a good deal of patience. Nutty Mutts cannot guarantee that this will work, as each animal is an individual case, nor is it possible to foresee if another problem may arise as a result of the treatment. All programs are specific to a certain animal and should not be tried on any other pet, only the animal whose name that appears on the information.

Nutty Mutts encourages clients to contact their veterinary surgeon prior to putting the actions into effect, if they are concerned. By booking one of Nutty Mutt’s services, you are agreeing to these Terms and Conditions. Once booked and paid for, there is no refund available.

Nutty Mutts reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause. By booking you will agree to keep the date and time of the consultations. If changes to the date and/or time need to be altered by you, then 48 hours notice will need to be given, otherwise a charge of £10 will be incurred on top of the existing consultation fee.

 

Bookings

Nutty Mutts will send you a confirmation or receipt when payment is made in full or first payment is received if requested.

If you need to cancel this training session, then unless Nutty Mutts are notified within 48 hours, no refund is given.

Whilst every care is taken to ensure the safety of both you and your dog whilst attending this workshop/training course with Nutty Mutts, please note that no responsibility can be accepted by Nutty Mutts for any injury to yourself or your dog, or any sickness or disease contracted.

I have read the above conditions relating to training with Nutty Mutts and agree to be bound by them.

Data Protection

Nutty Mutts will collect information from you for registration and training purposes and be in accordance with the Data Protection Act 1998. None of this information is ever passed on to a third party. By booking onto a class or training sessions you will be added to our mailing list and can unsubscribe at any time by emailing nuttymutts@outlook.com with the subject title “UNSUBSCRIBE”. We will also take photos during classes/sessions and use feedback for marketing purposes (website, Facebook, etc), only first names will be used; please let Nutty Mutts know if you do not want photos or feedback used in this way.

 

Disclaimer

Owner agrees to indemnify and hold Nutty Mutts harmless from all liability for any loss, damage or injury to persons, animals or property arising from or related to owner’s pet.
